These Terms of Use ("Terms") govern access to and use of the BidMasters e-auction platform ("Platform"), operated by CostMasters Technologies Pvt. Ltd. ("Auction Company", "we", "us"). By registering, logging in, or participating in any event on the Platform, you ("Bidder", "you") agree to be bound by these Terms. If you do not agree, you must immediately discontinue use of the Platform.
Account, Access & KYC
The Bidder shall create an account, complete Platform KYC as required, and maintain strict confidentiality of all login credentials. All activity conducted under an account is attributed to and the responsibility of the registered Bidder.
The Auction Company may approve, suspend, or terminate access at any time for policy violations, security concerns, or legal requirements, without incurring liability to the Bidder.
You represent that all registration information you provide is accurate, current, and complete, and that you are duly authorised to participate in auctions on behalf of yourself or your organisation.
Platform Use & Conduct
- Use the Platform solely for lawful bidding activity in connection with auctions posted by verified Sellers.
- Not interfere with, disrupt, or attempt to gain unauthorised access to Platform systems, servers, or networks.
- Not deploy bots, scrapers, crawlers, or any automated tools on the Platform without prior written consent from the Auction Company.
- Not post, transmit, or distribute any unlawful, defamatory, fraudulent, or intellectual-property-infringing content.
Event Configuration & Run Rules
The Auction Company publishes event parameters—including start time, scheduled close time, auto-extension rules, minimum bid increments, bid visibility settings, and rank-display settings—on behalf of the Seller. These parameters are event-specific and may vary across auctions.
The Auction Company reserves the right to pause, cancel, or reschedule events for technical, legal, regulatory, or security reasons. Bidders will be notified through in-platform notifications or registered email where practicable.
Bid Submission & Integrity
Bids, once submitted and confirmed on the Platform, are final, irrevocable, and legally binding on the Bidder in accordance with event-specific rules, subject only to the Seller's confirmation of sale.
In rank-only or anonymised events, certain competitor information is intentionally withheld by design. The non-display of competitor identity or bid values in such events is not a technical defect.
A successful bid (L1 or awarded status) creates an obligation on the Bidder to complete the transaction in accordance with the Seller's commercial terms.
Technical Requirements & Service Availability
The Bidder is solely responsible for ensuring compatible devices, a stable internet connection, and access through permitted networks or firewalls. Connectivity failures on the Bidder's side do not excuse non-participation or invalidate competing bids.
While the Auction Company takes commercially reasonable efforts to maintain Platform availability, the Platform is provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of uninterrupted or error-free operation.
In the event of a material outage impacting fair competition, the Auction Company may, in its discretion and in consultation with the Seller, extend or re-run the affected event. The Auction Company's decision on the appropriate remedy is final.
Fees & Charges
Platform access fees applicable to Bidders, if any, will be disclosed in advance within event details or the registration page.
All applicable taxes on platform fees (including GST) shall be borne by the Bidder. Tax invoices will be issued as required by applicable law.
Intellectual Property
All rights in BidMasters, including its software, user interface, databases, documentation, trademarks, service marks, and proprietary content (excluding Seller-uploaded materials), are owned exclusively by the Auction Company.
No rights are granted to the Bidder except a limited, non-exclusive, non-transferable, revocable license to access and use the Platform for the purpose of participating in auctions.
Limitation of Liability & Indemnification
To the maximum extent permitted by applicable law, the Auction Company disclaims all implied warranties and limits its liability for any indirect, incidental, consequential, or punitive damages, including loss of profits or business interruption, arising from the use of or inability to use the Platform.
The Auction Company's total aggregate liability to any Bidder in connection with these Terms shall not exceed the platform access fees (if any) paid by that Bidder in the preceding three (3) months.
The Bidder agrees to indemnify, defend, and hold harmless the Auction Company and its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from:
- The Bidder's use or misuse of the Platform.
- Breach of these Terms.
- Violation of any applicable law or third-party rights.
Relationship to Seller Terms
These Platform Terms are distinct from the commercial terms between Seller and Buyer. The Auction Company acts as a technology facilitator and is not a party to any sale contract formed between a Seller and a Bidder/Buyer through the Platform.
In the event of a conflict, auction-specific rules and the Seller's confirmed sale terms shall prevail for the commercial transaction; these Terms govern Platform access and bidding conduct.
Suspension & Termination
The Auction Company may suspend or terminate any account or event to protect Platform integrity, comply with applicable law, or address violations of these Terms. Provisions intended to survive termination—including indemnity, intellectual property, and limitation of liability—shall continue in full force and effect after termination.
Amendments & Notices
These Terms may be updated from time to time. Updated Terms will be posted on the Platform, and your continued use constitutes acceptance of the revised Terms. Notices may be communicated through in-Platform notifications or email to your registered address.
Dispute Resolution & Governing Law
The parties shall first attempt to resolve any dispute amicably within fifteen (15) days of written notice.
Bidder's Acknowledgement: By creating an account and participating in any e-Auction on BidMasters, the Bidder accepts these Terms of Use, together with event-specific rules published for each auction.
